The single most misunderstood Nevada law: prostitution is a crime in Las Vegas and all of Clark County. It's legal only in licensed brothels in a handful of rural counties — and solicitation stings on the Strip are routine.

Ask tourists what they know about Nevada law and many will confidently tell you prostitution is legal in Las Vegas. It is not — and the misunderstanding produces real arrests every week. Nevada's system is county-option brothel licensing, dating to a 1923 licensing act and cemented by a 1971 amendment giving counties control after Storey County licensed the Mustang Ranch. Counties may license brothels; outside a licensed house, prostitution is a crime everywhere in the state under NRS 201.354.

The statute that locks Las Vegas out is NRS 244.345(8): "In a county whose population is 700,000 or more, the license board shall not grant any license to a petitioner for the purpose of operating a house of ill fame or repute or any other business employing any person for the purpose of prostitution." The population threshold — raised from 400,000 to 700,000 in 2011 as Clark County grew — is drafted so that it has only ever excluded Clark County, home of Las Vegas. Washoe County (Reno) also prohibits brothels by county ordinance. Roughly 20 licensed brothels operate, all in rural counties.

This is not a technicality that goes unenforced. Solicitation stings on the Strip are routine, and both sellers and customers are arrested. Under NRS 201.354, engaging in prostitution or solicitation outside a licensed house is a misdemeanor, with escalating penalties for customers. Visitors who assumed "it's Vegas, it's legal" discover the truth in handcuffs — often with consequences that follow them home: a criminal record, court dates in another state, and charges that are publicly searchable. The gap between Nevada's reputation and Nevada's law is nowhere wider than here.
